Data protection information for business partners

In the following, we would like to inform you in an understandable and compact form about the collection and processing of your data by us as well as your rights in this regard.

This information deals exclusively with the processing of personal data of employees of our business partners in the course of general business operations.

II. Purposes of data processing and legal bases

We process your personal data on the basis of the provisions of the General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG) and all other applicable laws.

The legal basis for the processing of personal data for pre-contractual and contractual purposes is Art. 6 (1b) GDPR if you yourself are our contractual partner or Art. 6 (1f) GDPR if your employer is our contractual partner. This applies in each case to processing that takes place within the framework of a contract between you or your employer and us and includes, in particular, the advertisement or initiation of the contractual relationship, contract processing, implementation and support as well as processing of the contractual relationship.

In the course of this, we usually process contact data of contractual partners and contacts, contract data and communication.

We also process your data to protect our legitimate interests or those of third parties (Art. 6 (1f ) GDPR). This may particularly be necessary:

  • for carrying out internal and external correspondence including documentation, office
  • communication and support for evaluations; for creating, controlling and archiving of
  • information, documents and business processes as well as storage of address data of contact
  • persons at business and other communication partners;
  • to ensure IT security and IT operations;
  • to carry out communication processes and for the exchange of information;
  • to perform internal quality controls;
  • to maintain proper business operations, in particular for accounting and risk management purposes;
  • to enforce our legal claims and
  • to meet our legal and contractual obligations.

Should we ever obtain consent for the processing of your data (Art. 6 (1a) GDPR), you can revoke this consent at any time with effect for the future.

III. Recipients or categories of recipients of personal data

Within our company, only those persons and offices receive your personal data that need them to fulfil their tasks with regard to the above-mentioned purposes. In the course of our activities, we may sometimes have to transmit data to external third parties and use external service providers. In particular, we may transfer your personal data to the following recipients and categories of recipients:

  • Technical service providers, such as IT and hosting service providers, telecommunications service providers;
  • Government agencies and authorities, e.g. for law enforcement or security purposes;
  • Commercial service providers, auditors, tax consultants and lawyers and
  • Contractual partners (as far as necessary e.g. for the fulfilment of contracts).

In some cases, we also use affiliated companies as service providers.

If we transfer personal data to service providers outside the European Economic Area (EEA), transfer will only take place if such third country has been confirmed by the EU Commission as having an adequate level of data protection or other adequate data protection guarantees exist (e.g. on the basis of so-called standard contractual clauses of the European Commission) are in place https://commission.europa.eu/publications/standard-contractual-clauses-international-transfers_en.

 

IV. Duration of data storage

We will delete your personal data as soon as it is no longer required for the above-mentioned purposes. In the course thereof, personal data may be retained for the period during which claims can be made against us (statutory limitation period of three or up to thirty years). Furthermore, we store your personal data insofar as we are legally obliged to do so. Corresponding obligations to provide proof and to store data result, among other things, from the German Commercial Code (Handelsgesetzbuch) and the German Fiscal Code (Abgabenordnung). The storage periods are generally up to six or ten years. If required, we will be happy to provide you with further information on the duration of data storage in relation to the specific purpose.

 

V. Rights of data subjects

Beside the right to revoke any consent given to us, you are entitled to a right of information under Article 15 GDPR, a right to rectification under Article 16 GDPR, to deletion under Article 17 GDPR, to restriction of processing under Article 18 GDPR, a right to object to processing under Article 21 GDPR and a right to data portability under Article 20 GDPR if the respective legal prerequisites are met.

On grounds relating to your particular situation, you have the right to object at any time to processing of your personal data which is based on Art. 6, (1) lit. f GDPR (Art. 21 (1) GDPR). Insofar as we process your personal data for direct marketing purposes pursuant to Art. 6 (1f) GDPR, you have the right to object to this at any time, even without stating reasons (Art. 21 (2) GDPR).

Moreover, you have the right to lodge a complaint with the data protection supervisory authorities under Article 77 GDPR.
